Four Madison residents whose homes neighbor a proposed West Side apartment building are suing over the City Council`s approval of the project.In a petition filed Friday in Dane County Circuit Court, Jeffrey L. Western, Kathy L. Western, Paul F. Umbeck Jr. and Mary A. Umbeck argue that the three-story, 138-unit development at 6610–6706 Old Sauk Road would "substantially" increase the risk of flooding on their properties, both of which have "existing stormwater issues."
The City Council voted in June to rezone the property to allow for construction of the apartment building. The rezoning conflicts with Madison`s comprehensive plan, the lawsuit alleges, "and fails to account for existing conditions" at the site...
